TWO MEN CHARGED IN FATAL CRASH

Denver District Attorney Bill Ritter, Jr. has formally charged two men with multiple felony counts in connection with a fatal crash and the attempted murder of a police officer last weekend.

Justin Davis (DOB: 5-1-83) is charged with first-degree murder with extreme indifference (F1), vehicular homicide (F4), vehicular assault (F5), attempted first-degree murder of a peace officer (F2), second-degree assault of a peace officer (F4), second-degree burglary (F3), and leaving the scene of an accident resulting in death (F4).

Cesar Navarette (DOB: 9-13-83) is charged with first-degree criminal trespass (F5) and possession of a controlled substance (F6).

The charges allege that on Saturday, September 11, 2004 Davis and Navarette were driving on I-70 when Davis fired shots at a Denver police officer who was driving in uniform in his personal vehicle.  The charges allege that a short time later they ran a stop sign at 38th Avenue and Bryant Street causing a crash that killed 62-year-old Judith Miller and injured her husband, 65-year-old Jerry Miller.

Both men remain in custody in the Denver County Jail.  Davis is being held without bond; the bond for Navarette has been set at $500,000.  They will be advised of the charges on September 20, 2004 at 9 a.m. in Denver County Court, room 12T.
