Convict Facing New Charges After DNA Match
Denver
District Attorney Bill Ritter, Jr. has formally charged a man
today in connection with a burglary and attempted sexual assault
that occurred two years ago, after DNA linked him to the crime.
Juan Hernandez-Garcia (DOB: 5-26-72)
is charged with
second -degree burglary (F-3) and attempted sexual
assault on a child (F-4).
The charges allege
that in July 2002, Garcia crawled through an open kitchen window
in a Denver home by
removing the screen. The window had been left open on a
hot summer night. Garcia was discovered in the bedroom of
a 10-year-old girl and fled when she began screaming. DNA
was recovered and submitted to a database, but no suspect was
identified at the time.
In January 2004, a
DNA match was found after Hernandez-Garcia began serving a
Department of Corrections sentence for criminal trespass. If he
is convicted on these new charges he will no longer be eligible
for parole in June of this year.
With warm weather
approaching, it is important to remember the risks of leaving
doors unlocked and windows open. Remind yourself and
others that window
locks should be used whenever possible and ground level windows
should never be left open wide enough for someone to enter.
