 Man Charged in Child Abuse Case

 

Denver District Attorney Bill Ritter, Jr. formally charged a man today in connection with the death of a two-year old boy last Saturday.

 

Jose Torres (DOB 4-6-82) is charged with first-degree murder (F1)* and child abuse resulting in death (F2).

 

The charge alleges that Torres pushed Mike Elias into a coffee table, causing internal injuries that resulted in his death.  Elias also suffered injuries to his face, torso, and limbs. 

 

Torres remains in custody at the Denver County Jail and will appear in Denver County Court on February 24, 2004 at 9:00 am in courtroom 12T for advisement.

*Torres is charged with first-degree murder under statute 18-3-102(1)(f): “The person knowingly causes the death of a child who has not yet attained twelve years of age and the person committing the offense is one in a position of trust with respect to the victim.”


*The filing of a criminal charge is merely a formal accusation that an individual(s) committed a crime(s) under Colorado laws.  A defendant is presumed innocent until and unless proven guilty.  See Colo. RPC 3.6
