INVESTIGATION CONCLUDES WITH NO
CHARGES
A five-month investigation into an allegation of sexual assault
at a lower downtown nightclub has been completed.
The investigation began on August 23, 2005 when a woman at
Lutheran Hospital in Wheat Ridge reported that she had been
sexually assaulted the previous night at a private party in
Denver. The Denver District Attorney’s Office and the internal
affairs bureau of the Denver Police Department became involved
in the investigation immediately when it was learned that the
event was a private retirement party for a Denver police officer
and many in attendance were police officers.
The investigation was lengthy,
complete, and thorough, involving scores of witness interviews,
the execution of multiple search warrants, crime scene analysis,
and other forensic analysis. Based on a review of all the facts
developed in this investigation, it is our conclusion that the
allegation of sexual conduct without consent cannot be proven
beyond a reasonable doubt, unanimously, to a jury of twelve at
trial, which is our burden of proof. Therefore, no criminal
charges will be filed.
