CHARGES FILED IN MURDER CASE

 

Denver District Attorney Mitch Morrissey has formally charged a man accused of killing 28-year-old Benjamin Garcia-Diaz earlier this year.  The victim had been reported missing in March; his body was found in rural Weld County on September 5, 2005.

 

Martin Villanueva (DOB: 12-07-81) is charged with first-degree murder after deliberation (F1).

 

The charge alleges that Villanueva shot and killed Garcia-Diaz in Denver sometime between March 26 and 27, 2005 and left the victim’s body in rural Weld County where it was found in early September. 

 

Villanueva was arrested on September 14, 2005 by the Denver Police Department and remains in custody in the Denver County Jail where he is being held without bond.  His is scheduled to be advised of the charge on September 26, 2005 at 9 a.m. in Denver Count Court, room 12T.
