CASE FILING UPDATE

March 18, 2002

Charges have been filed today in two cases of note:

Bernard Montoya (DOB: 4-18-51) is charged with menacing (F5) and third degree assault (M1) in connection with an incident that occurred while Montoya was working on-duty as a Denver Police Officer.  The charges allege that while Montoya was responding to a call in an unmarked police car on March 6, 2002 he became involved in a traffic altercation.  The charges allege that Montoya got out of his car at 38th and Clay, pointed his service weapon at a teenage driver of another car,  hit him in the face with his hand.  Montoya is scheduled to appear in Denver County Court, room 12T, on Thursday, March 21, 2002 to be formally advised of the charges.

 Anthony Pacheco (DOB: 5-12-71) is charged with sexual assault on a child (F4) and sexual assault on a child by a person in a position of trust (F3).  The charges allege that the victim was first approached in an online chat room and was later assaulted in a Denver residence.  Pacheco is scheduled to appear in Denver County Court, room 12T, on Wednesday, March 20, 2002 at 9:00 a.m. to be advised of the charges
