Discovery

What is “Discovery”?

Discovery is the procedure by which the Denver District Attorney’s Office provides information, facts, documents, and other materials to the defense regarding a filed case, as governed by the Colorado Rules of Criminal Procedure. Discovery material is submitted by the Denver Police Department or obtained during further police and district attorney office investigation. Discovery does not include the work product generated by the District Attorney’s Office.

Discovery Requests

Discovery is available on active cases to the attorney of record and to pro-se defendants only. Discovery will not be released to a defendant represented by counsel.

For all other records requests pursuant to the Colorado Open Records Act (CORA) or the Colorado Criminal Justice Records Act (CCJRA) please follow the Records Requests procedure.

Discovery Room hours: 8:00 a.m. to 5:00 p.m., Monday through Friday. The Office requests three business days’ notice to prepare discovery.

Instructions to Obtain Discovery

Instructions for obtaining discovery may be heard by calling 720-913-9044.

Attorneys: Discovery will be provided to the attorney of record. Order discovery by emailing your request with an attached court-filed entry of appearance or order of court appointment to discovery@denverda.org.

Discovery is produced electronically. When processed, you will receive a link to download your discovery items from the CDAC eDiscovery site and/or Evidence.com.

If there is discovery that needs to be picked up a District Attorney staff person will notify the attorney. Attorneys may send a professional courier company or law firm employee to pick up discovery. An authorization letter on office letterhead will be required before discovery is released.

If necessary discovery may be required to be generated on to a DVD or a Blu-ray disc. THESE DISCS REQUIRE A DVD OR BLU-RAY READER TO ACCESS THE FILES. THE DA’S OFFICE CANNOT ACCOMMODATE REQUESTS TO PRODUCE DISCOVERY IN AN ALTERNATE FORMAT. To do so would require original formats to be altered and is a potential violation of Colo.R.Crim.P. Rule 16.

In some instances, you may be required to provide a hard drive if the volume of discovery is greater than the capacity of a DVD or Blu-ray disc. A representative of the DA’s Office will reach out to you if this is the case.

Pro-se / Self-Represented Defendants: Please complete the request form online. You will be notified when the discovery is ready to be picked up at our office. Only the defendant (ID required) may pick up this discovery. Parents of juveniles (with appropriate identification) may order and pick up discovery.
