Investigation and Decision Re January 1, 2020 Shooting of Gerardo Antonio Conchas-Bustos

DENVER—Denver District Attorney Beth McCann’s legal review of the officer-involved shooting that occurred on January 1, 2020 at 901 S. Irving Street in Denver is complete. DA McCann concluded that the shooting was legally justified and that no criminal charges are warranted against Denver Police Officers Juan Gamboa and Diego Archuleta for the reasons outlined in the letter.

“Earlier that night, Mr. Conchas-Bustos physically assaulted his housemate who called 911 Dispatch for help,” said DA McCann. “The responding officers were in the process of conducting a safety check of the house when Mr. Conchas-Bustos quickly charged at Officer Gamboa with a knife in his hand,” said DA McCann. “Mr. Conchas-Bustos got within three to five feet of Officer Gamboa before being shot and killed. These officers acted in self-defense and in defense of others.”
